1. Acceptance of Terms

By accessing or using SendRizz (“Service”, “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SendRizz is an AI-powered content marketing automation platform that provides:

AI-generated content creation (articles, images, marketing copy)
Marketing automation workflows
Email marketing campaigns
Multi-platform content distribution
Analytics and performance tracking

3. User Accounts and Registration

3.1 Account Creation

You must provide accurate, complete information when creating an account
You are responsible for maintaining the security of your account credentials
You must notify us immediately of any unauthorized use of your account

3.2 Eligibility

You must be at least 18 years old to use this service
You must have the legal capacity to enter into binding agreements
Business accounts must be authorized to bind the organization

4. Credit System and Billing

4.1 Credit-Based Usage

SendRizz operates on a credit-based system
Credits are consumed based on usage of AI features and automations
Unused credits expire according to your subscription plan terms

4.2 Subscription Plans

Free Plan: 100 credits/month
Starter: $9/month (500 credits)
Pro: $29/month (2,000 credits)
Business: $99/month (10,000 credits)

4.3 Credit Packs

One-time credit purchases available
Credits from packs do not expire for 12 months from purchase date

4.4 Billing Terms

Subscription fees are billed monthly in advance, or yearly in advance
All fees are non-refundable except as expressly stated in Section 5 (Refunds and Cancellations)
We reserve the right to change pricing with 30 days notice

5. Refunds and Cancellations

5.1 Subscription Refunds

Refund Eligibility:

Full refund available within 7 days of initial subscription
Partial refund for service outages exceeding 24 consecutive hours
Pro-rated refunds for mid-cycle plan downgrades

Refund Process:

Contact support within the eligible timeframe at support@sendrizz.com
Refunds processed within 5-10 business days
Refunds issued to original payment method

5.2 Credit Pack Refunds

Refund Eligibility:

Full refund within 48 hours if no credits used
No refund once credits have been consumed
Technical issues may qualify for credit restoration

Credit Expiration:

Purchased credits expire 12 months from purchase date
No refund for expired credits
Email reminders sent before expiration

5.3 Service Level Guarantees

99.9% Uptime Commitment:

Service availability measured monthly
Planned maintenance excluded from calculations
5% credit for each 4-hour period of downtime (maximum 50% monthly subscription credit)
Must request credit within 30 days of outage

5.4 Refund Exclusions

The following are not eligible for refunds:

Subscription fees after 7-day initial period
Credits consumed through normal platform usage
Account suspension due to Terms of Service violations
Fraudulent or abusive usage
Dissatisfaction with AI-generated content quality
User error or misunderstanding of features

5.5 Cancellations

Subscription Cancellation:

Access continues until end of current billing period
No refund for remaining days in current cycle
Can reactivate anytime before period ends

Plan Changes:

Upgrades: Immediate access with pro-rated billing
Downgrades: Changes take effect at next billing cycle

5.6 Refund Request Process

To request a refund, contact support@sendrizz.com with:

Account email address
Transaction ID or invoice number
Reason for refund request
Detailed explanation of issue

Initial response within 24 hours, investigation completed within 5 business days.

6. Acceptable Use Policy

6.1 Permitted Uses

You may use SendRizz for lawful business purposes including:

Creating marketing content for your business
Automating legitimate marketing workflows
Building email marketing campaigns
Generating images and written content

6.2 Prohibited Uses

You may not use SendRizz to:

Create misleading, fraudulent, or deceptive content
Generate spam or unsolicited communications
Violate any applicable laws or regulations
Infringe on intellectual property rights of others
Create content that is defamatory, obscene, or offensive
Attempt to reverse engineer or hack the platform
Resell or redistribute our services without permission

6.3 Content Responsibility

You are solely responsible for all content created using our platform
You warrant that your use complies with all applicable laws
We reserve the right to remove content that violates these terms

7. Intellectual Property Rights

7.1 Your Content

You retain ownership of content you input into the platform
You grant us a license to process your content to provide our services
You are responsible for ensuring you have rights to all content you upload

7.2 Generated Content

AI-generated content created through our platform belongs to you
You are responsible for ensuring generated content doesn’t infringe third-party rights
We make no warranties about the originality of AI-generated content

7.3 Platform Rights

SendRizz platform, features, and technology remain our property
These Terms do not grant you any rights to our trademarks or brand elements

8. Privacy and Data Protection

8.1 Data Collection

We collect and process data as described in our Privacy Policy
You consent to our data practices by using the service

8.2 Data Security

We implement reasonable security measures to protect your data
You acknowledge that no system is completely secure

9. Service Availability and Support

9.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service
Scheduled maintenance will be announced in advance when possible

9.2 Support

Support is provided via email and in-app messaging
Response times vary by subscription tier
We do not provide phone support

10. Limitation of Liability

10.1 Service Disclaimer

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10.2 Liability Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10.3 Excluded Damages

WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR DATA.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses arising from:

Your use of the service
Your violation of these Terms
Your violation of any third-party rights
Content you create or distribute using our platform

12. Termination

12.1 Termination by You

You may cancel your subscription at any time
Access continues until the end of your current billing period
Data export must be completed before account closure

12.2 Termination by Us

We may terminate your account for:

Violation of these Terms
Non-payment of fees
Illegal or harmful use of the service
At our discretion with 30 days notice

12.3 Effect of Termination

Your right to use the service ceases immediately
We may delete your data after a reasonable grace period
Termination does not relieve payment obligations

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction] without regard to conflict of law principles.

You may not assign these Terms without our consent. We may assign our rights and obligations at any time.
